Did you know that spying on your partner's mobile or another person's is a crime in Spain?


Spying, extracting and disseminating private information about/from your partner or another person is considered a crime that violates their right to privacy, one of the fundamental rights of the Constitution in Spain.


This action or crime is included in the Criminal Code and is punishable by prison sentences of one to four years in prison.

Borrowing the mobile phone of a friend or our partner's without their authorization is a very common action in our days. However, it is something that has consequences classified in article 197 of Spanish Penal Code as a crime of discovery and disclosure of secrets.

Moreover, and specifically, the Spanish Constitution states that spying on a person's phone violates their privacy and the secrecy of communications recognized in article 18 of our 1978 Constitution.
