Getting divorce in the context of a criminal proceeding of violence against a woman

If a gender violence criminal procedure is being processed in a Gender Violence Court in Spain or an order of protection has been agreed for the woman, the divorce, separation or paternal filial measures will be brought before the Court of violence against women and not joint custody will proceed.

The petition lawsuit for divorce must be filed within 30 days of the notification of the Order in which the protection order was agreed.

Generally speaking, the Gender Violence Judge may adopt civil measures on: the attribution of the use and enjoyment of the family home, determine the care and custody regime of the children, visits, communication and stay.
