Is it a crime for a third party to use the parking card for people with disabilities in Spain?

In the specific case to which we are going to refer, the accused was “hunted” using the card of a person who had already died. Overturning the sentence handed down by the court of first instance, the Criminal Chamber of the Supreme Court acquitted the woman who was caught using the parking card for people with reduced mobility issued for another person who, as explained, had already died. The criminal type requires the existence of the final element consisting of harming another, a condition that did not occur in this specific case. The sentence, of February 24th, 2022, did not confirm the existence of any damage to third parties derived from the use of the card nor the intention to cause it, therefore the woman was acquitted.
