The crime of "insulting" in Spain


Insults in Spanish Law are criminally punishable by a fine. An insult is basically an expression that attacks the dignity and fame of a citizen. So, for example if you insult a person on social networks or WhatsApp, we have two scenarios:


- If you insult the person "with" publicity, that is, you spread it on the networks, it is a serious insult and the penalty ranges from 6 to 14 months of fine.


- If you insult "without" publicity, the penalty is reduced, from three to seven months of fine.


In addition, the judge would assess the circumstances of the case, since many people who slander think that they are protected by freedom of expression and can say whatever they want against whoever they want.


If all the insults made on social networks were reported, there would be no courts, judges or lawyers in the world to deal with them. Therefore, criticizing is not insulting, but the difference is wanting deliberately to cause damage.
