The Hate Crime in Spanish Law. What is it?


The hate crime is a recent addition to the Spanish legal system and it is regulated in article 510 of the Penal Code. Anyone who publicly promotes hatred or violence towards a group for reasons of race, sexual orientation, religion, beliefs or simply because they have a disability commits a hate crime. Anyone who is hostile towards another person for any of the reasons stated above also commits a hate crime. The hate crime does not consist in hating a person for personal reasons, but in doing so for reasons of race, religion, sexual orientation, etc. That is, the key is in the motives, not in the fact of hating someone. Additionally, to commit a hate crime, it must be manifested publicly.
