Types of Courts in Spain

In Spain the jurisdictional organization is established hierarchically and based on territorial criteria (province, autonomy and state) and objectives based on what is judged.

At a National level and at the top of the “jurisdictional pyramid” we find the Supreme Court as the highest decision-making and reviewing body, although strongly influenced by two interpreting bodies: the Constitutional Court as the highest interpreter of the Constitution in Spain and the Court of Justice of the European Union as the highest interpreter of the Union ordinance. Below these we find various types of organs:

  • Provincial Courts

  • High Courts of Justice or Courts of Justice of the Autonomous Communities

  • National Audience
