When can a nephew receive an inheritance without a will?
There are two situations in which nephews can receive the assets of an intestate estate (without a written or valid will) and we analyze them below.
1) Death
It may be the case that the family members who precede the nephews in the succession line are deceased (that is, the spouse and the direct ascendants and descendants).
2) Waiver
If the relatives who precede the nephews decide to renounce the will, the latter would be the beneficiaries. In such a case, the deceased's siblings would reject the assets to transfer them to their own children.
